Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Ready on Record, operated by Ready on Record LLC, a Virginia limited liability company (“we,” “us,” or “our”). By creating an account or using Ready on Record, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

Ready on Record is a web-based interview practice platform. Users record video responses to randomly assigned questions, receive AI-generated feedback scored across multiple dimensions, and retain a history of past sessions. Video is recorded and stored locally on your device only. We never receive or store your video recordings. Audio is extracted from your recording solely to generate a transcript, which is used to produce your feedback.

2. Eligibility

You must be at least 18 years old to use Ready on Record. By using the service, you represent that you meet this requirement. If you are using Ready on Record on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

You must create an account to use Ready on Record. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@readyonrecord.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Paid Plans and Billing

4.1 Free Tier

New accounts receive 2 practice sessions at no charge. Free sessions do not expire.

4.2 Pro Subscription

Pro is available as a monthly subscription ($9.99 USD/month) or a quarterly subscription ($24.99 USD/quarter, billed every 3 months). Pro provides unlimited practice sessions for the duration of the active subscription. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period; you retain access to Pro features through that date.

4.3 Payment Processing

Payments are processed directly by Stripe. By purchasing a plan, you authorize the applicable charges to your payment method. You agree to provide accurate and complete billing information.

4.4 No Refunds

All purchases are final. We do not offer refunds for the current billing period of a Pro subscription. If you believe a charge was made in error, contact us at support@readyonrecord.com within 30 days.

4.5 Price Changes

We reserve the right to change pricing at any time. Price changes to Pro subscriptions will be communicated at least 30 days in advance and will apply at the next billing cycle after the notice period.

5. Acceptable Use

You agree not to:

  • Use Ready on Record for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or extract data from the service
  • Share your account credentials with others
  • Submit content that is abusive, harassing, defamatory, or otherwise harmful
  • Attempt to interfere with or disrupt the service or its infrastructure
  • Use automated tools to generate sessions or interact with the API outside of normal use

We reserve the right to suspend or terminate accounts that violate these restrictions without notice or refund.

6. AI-Generated Content

Ready on Record uses third-party AI services (Anthropic Claude) to generate feedback on your practice responses. AI-generated feedback is provided for informational and educational purposes only. It does not constitute professional career advice, legal advice, or any other form of professional guidance. We make no representations about the accuracy, completeness, or suitability of AI-generated feedback for any particular purpose.

7. Intellectual Property

7.1 Our Property

Ready on Record, including its design, software, question banks, and all related materials, is owned by Ready on Record LLC or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or other brand features.

7.2 Your Content

You retain ownership of any content you submit, including audio recordings and responses. By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the service (transcription and AI feedback generation). We do not use your content to train AI models or share it with third parties beyond what is necessary to deliver the service.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, READY ON RECORD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10.00 USD.

10. Indemnification

You agree to indemnify and hold harmless Ready on Record LLC and its officers, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

11. Data and Privacy

Your use of Ready on Record is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. GDPR: Additional Rights for EEA and UK Users

If you are located in the European Economic Area (EEA) or the United Kingdom, you have additional rights under the General Data Protection Regulation (GDPR) or UK GDPR. These rights are described in our Privacy Policy, including your right to access, correct, delete, and port your personal data, and to lodge a complaint with a supervisory authority.

13. Termination

We may suspend or terminate your access to Ready on Record at any time for any reason, including violation of these Terms. Upon termination, your right to use the service ceases immediately. You may request deletion of your account and associated data at any time by contacting us at support@readyonrecord.com.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a notice on the service at least 14 days before taking effect. Continued use of Ready on Record after the effective date constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Virginia, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of Ready on Record shall be resolved in the state or federal courts located in Virginia, and you consent to personal jurisdiction in those courts.

16. Miscellaneous

  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Ready on Record LLC regarding Ready on Record.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
  • No Waiver: Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
  • Assignment: You may not assign your rights under these Terms. We may assign ours without restriction.
